CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

  1. By placing an electronic order through the website you are using, you are considered to have accepted the pre-information form and the distance sales contract provided to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Sales Regulation (Official Gazette: 27.11.2014/29188) regarding the sale and delivery of the products, as well as other applicable laws.

  3. Shipping costs for product delivery shall be paid by the buyer.

  4. Each purchased product will be delivered to the person and/or organization at the address provided by the buyer within the 30-day legal period. If the product is not delivered within this period, the buyer may terminate the contract.

  5. The purchased product must be delivered complete, in accordance with the specifications mentioned in the order, and include any relevant documents, such as warranty certificates or user manuals.

  6. In the event that the product becomes impossible to sell, the seller must notify the buyer in writing within 3 days of learning about this situation. The full payment must be refunded to the buyer within 14 days.

IF THE PRODUCT PAYMENT IS NOT MADE:

  1. If the buyer does not pay for the product or cancels the payment through bank records, the seller's obligation to deliver the product is terminated.

TRANSACTIONS MADE THROUGH UNAUTHORIZED USE OF THE CREDIT CARD:

  1. If, after the product has been delivered, it is determined that the payment made using the buyer’s credit card was unauthorized, and the amount for the product is not paid to the seller by the bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

  1. If unforeseeable force majeure events occur that prevent the product from being delivered on time, the buyer will be notified. The buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is resolved. If the buyer cancels the order and payment was made in cash, the buyer will receive a refund within 14 days of the cancellation. If the buyer paid by credit card and cancels, the payment will be refunded to the bank within 14 days, but the bank may take 2-3 weeks to process the refund to the buyer’s account.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

  1. Before accepting the delivery of the product/service, the buyer must inspect it. If the product is damaged (e.g., broken, with torn packaging), the buyer should not accept it. The product/service will be considered accepted as long as it is undamaged and intact upon delivery. After delivery, the buyer is responsible for properly preserving the product/service. If the right of withdrawal is to be exercised, the product/service must not have been used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The buyer can exercise the right of withdrawal within 14 (fourteen) days from the delivery date of the purchased product to themselves or the person/organization they designated, without any legal or criminal liability and without providing any reason, by notifying the seller using the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchased product is a service, the 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where the service has begun before the withdrawal period ends with the buyer’s consent.

  2. The costs incurred due to the exercise of the right of withdrawal are the responsibility of the seller.

  3. To exercise the right of withdrawal, the buyer must notify the seller in writing via registered mail, fax, or email within the 14-day period, and the product must not have been used as per the provisions of this contract regarding "Products That Cannot Be Returned Under the Right of Withdrawal."

EXERCISE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to the buyer or a third party must be returned. If the invoice is issued to a corporate entity, the return must also include a return invoice issued by the company.

  2. The return form and the product must be delivered with its box, packaging, and any standard accessories, in complete and undamaged condition.

RETURN CONDITIONS:

  1. The seller must return the total amount and any documents binding the buyer within 10 days from the date the right of withdrawal notification is received. The seller is also required to accept the returned product within 20 days.

  2. If the product has decreased in value due to the buyer's fault or if the return is impossible, the buyer is liable for compensating the seller for damages proportional to the fault. However, the buyer is not responsible for changes and defects resulting from proper use of the product during the withdrawal period.

  3. If the withdrawal leads to a decrease in the total amount of the seller’s promotional campaign, any discounts applied under the campaign will be canceled.

PRODUCTS THAT CANNOT BE RETURNED UNDER THE RIGHT OF WITHDRAWAL:

  1. Products that are personalized or specifically tailored to the buyer’s needs and are not suitable for return, such as underwear, swimwear, makeup products, single-use items, goods that may spoil quickly or expire, products that cannot be separated from other products after delivery, goods whose packaging has been opened by the buyer, periodicals like newspapers and magazines, instant digital services, digital content delivered to the consumer immediately, audio or video recordings, books, software programs, data storage devices, and computer consumables cannot be returned if opened. The right of withdrawal does not apply to services that have been started before the period ends with the consumer’s consent.

  2. Cosmetics, personal care products, underwear, swimwear, books, copyable software programs, DVDs, CDs, VCDs, cassette tapes, and office supplies (such as toner, cartridges, and ribbons) can only be returned if they are unopened, unused, and undamaged.

DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer defaults on payment via credit card, they acknowledge and agree that they will be responsible for paying interest under the credit card agreement with the bank and that the bank may pursue legal action. In this case, the relevant bank may charge the buyer for the expenses and attorney fees, and the buyer agrees to compensate the seller for any damages due to delayed payment.
